&lt;/div&gt;&lt;div align="left"&gt;&lt;br /&gt;*You'll probably hear the word escrow many times during your home buying transaction, and the term can be confusing, because it is &lt;span style="color:#ff0000;"&gt;used to describe different events that take place before and after the real estate settlement&lt;/span&gt;, the day of closing when the property becomes yours.&lt;br /&gt;&lt;br /&gt;Let's take a look at the definition of the term escrow and the different ways it comes into play during your home buying transaction.&lt;br /&gt;&lt;br /&gt;Escrow: &lt;span style="color:#ff0000;"&gt;Documents or something else of value, often money, held by a neutral third party in order to be used at a later date to fulfill an obligation&lt;/span&gt;.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#663300;"&gt;&lt;span style="font-size:130%;"&gt;Escrow During the Home Buying Process&lt;/span&gt;&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;strong&gt;&lt;/strong&gt;&lt;br /&gt;&lt;strong&gt;     Earnest Money Deposits&lt;br /&gt;&lt;/strong&gt;*If you are buying a home, your first exposure to escrow was probably associated with the "earnest money deposit" that accompanied your offer to purchase the house. (This protects your "Good Faith" deposit) That money likely went into someone's trust account, where it will remain in escrow, protected by that neutral third party, until it is credited to you when the transaction closes (or is dispersed in other ways if the transaction fails to close).&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;     Escrow Agent&lt;br /&gt;&lt;/strong&gt;*You'll hear the term escrow used to describe the title company, attorney or another person who is hired to handle your closing transaction. That person is often called an escrow agent, because she maintains all documents and funds related to the transaction until the day of closing.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;     Lender Escrow Accounts&lt;/strong&gt;&lt;br /&gt;*The term escrow is used again to describe accounts your lender sets up in order to pay your home insurance and property taxes when they become due. Remember the initials &lt;strong&gt;PITI&lt;/strong&gt;? You saw them when the lender calculated your projected monthly payment. Those letters stand for the components of each payment: &lt;br /&gt;&lt;strong&gt; &lt;span style="color:#663300;"&gt;P&lt;/span&gt;&lt;/strong&gt;, Principal&lt;br /&gt;&lt;strong&gt; &lt;span style="color:#663300;"&gt;I&lt;/span&gt;&lt;/strong&gt;, Interest                                                                                                                                                 &lt;strong&gt;  &lt;span style="color:#663300;"&gt;T&lt;/span&gt;&lt;/strong&gt;, Taxes&lt;br /&gt;&lt;strong&gt; &lt;span style="color:#663300;"&gt;I&lt;/span&gt;&lt;/strong&gt;, Insurance&lt;br /&gt;&lt;br /&gt;*Tax and insurance bills are typically sent directly to your lender. Both of those bills are paid annually, but most lenders require you to pay 1/12th of the annual bill each month. The lender deposits the partial payments in an escrow account, where they'll accumulate until it's time to pay your taxes and insurance the following year.&lt;br /&gt;&lt;br /&gt;*You'll begin funding your your escrow accounts by making a payment into them at closing. &lt;/div&gt;&lt;p&gt;&lt;strong&gt;     RESPA Guidelines for Escrow Accounts&lt;/strong&gt;&lt;br /&gt;*The Real Estate Settlement Procedures Act (RESPA) (in USA) includes laws that all lenders must follow when funding and managing your escrow accounts.&lt;br /&gt;*RESPA does not require borrowers to maintain an escrow account with their lender--lenders make that decision. The laws do regulate the maximum amounts that a lender can require a borrower to maintain in an escrow account.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;     Escrow Account Cushions&lt;/strong&gt;&lt;strong&gt;&lt;br /&gt;&lt;/strong&gt;*Lenders can require borrowers to keep a cushion, or excess, balance in their escrow accounts to cover unanticipated increases in the following year's tax and insurance bills.&lt;br /&gt;&lt;br /&gt;*The cushion cannot be more than one-sixth of the total amount paid out of the account each year. That usually amounts to two months of escrow payments. Most lenders now require that borrowers fund their escrow accounts to the maximum amounts.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;     Must lenders pay interest on money held in escrow accounts?&lt;/strong&gt;&lt;br /&gt;*RESPA does not require lenders to pay interest, but some states do.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;    What if my lender doesn't pay my taxes on time?&lt;/strong&gt;&lt;br /&gt;*The lender should pay your taxes on time if your mortgage payments were paid on time. The lender must pay any penalties assessed to you for late payment. If the lender refuses, you can file a formal complaint with RESPA.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;    What should I do if my lender doesn't pay my hazard insurance and the policy is cancelled?&lt;/strong&gt;&lt;br /&gt;*Lenders are required to make payments on time if your mortgage payments were on time. Contact the lender immediately and fax a copy of the insurance bill, making sure it is sent to the correct department. Although,&lt;span style="color:#ff0000;"&gt; &lt;strong&gt;it is always advisable, even if it takes more time, for buyers to actually take time to read the documents and and to understand what they are signing.&lt;/strong&gt;&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size:130%;"&gt;What is a &lt;strong&gt;&lt;span style="color:#ff0000;"&gt;Deed of Trust&lt;/span&gt;&lt;/strong&gt;? &lt;/span&gt;&lt;br /&gt;*If you have never read a deed of trust, you might have questions about it. After all, &lt;span style="color:#ff0000;"&gt;it is the security for your loan&lt;/span&gt;. It is the &lt;span style="color:#ff0000;"&gt;document that is recorded in the public records&lt;/span&gt;.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size:130%;"&gt;A deed of trust &lt;strong&gt;contains three (3) parties&lt;/strong&gt;: &lt;/span&gt;&lt;br /&gt;*The &lt;strong&gt;&lt;span style="color:#ff0000;"&gt;Trustor&lt;/span&gt;&lt;/strong&gt;, which is you, the borrower&lt;br /&gt;*The &lt;strong&gt;&lt;span style="color:#ff0000;"&gt;Trustee&lt;/span&gt;&lt;/strong&gt;, which is an entity that holds "bare or legal" title&lt;br /&gt;*The &lt;strong&gt;&lt;span style="color:#ff0000;"&gt;Beneficiary&lt;/span&gt;&lt;/strong&gt;, which is the lender&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family:verdana;"&gt;&lt;span style="font-size:130%;"&gt;The deed of trust is &lt;strong&gt;an instrument that identifies the following&lt;/strong&gt;:&lt;br /&gt;&lt;/span&gt;*Original &lt;strong&gt;loan amount&lt;/strong&gt;&lt;br /&gt;*&lt;strong&gt;Legal description of the property&lt;/strong&gt; being used as security for the mortgage&lt;br /&gt;&lt;strong&gt;&lt;/strong&gt;*&lt;/span&gt;&lt;span style="font-family:verdana;"&gt;&lt;strong&gt;The parties&lt;br /&gt;&lt;/strong&gt;*&lt;strong&gt;Inception and maturity date&lt;/strong&gt; of the loan&lt;br /&gt;*&lt;strong&gt;Provisions of the mortgage and requirements&lt;/strong&gt;&lt;br /&gt;*&lt;strong&gt;Late fees&lt;/strong&gt;&lt;br /&gt;*&lt;strong&gt;Legal procedures&lt;/strong&gt;&lt;br /&gt;*&lt;strong&gt;Acceleration&lt;/strong&gt; (* Note 1) and &lt;strong&gt;alienation clauses&lt;/strong&gt; (* Note 2)&lt;br /&gt;*&lt;strong&gt;Riders&lt;/strong&gt;, if any, regarding such clauses as prepayment penalties or terms of an adjustable&lt;br /&gt;rate mortgage&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family:verdana;"&gt;&lt;span style="font-size:130%;"&gt;What is a &lt;strong&gt;&lt;span style="color:#ff0000;"&gt;Trustee&lt;/span&gt;&lt;/strong&gt;?&lt;br /&gt;&lt;/span&gt;Because &lt;strong&gt;mortgages do not contain a trustee&lt;/strong&gt;, many borrowers are confused between a mortgage and a deed of trust. &lt;strong&gt;Deeds of trust contain a trustee&lt;/strong&gt;, an independent third party that does not represent the borrower nor the lender.&lt;br /&gt;&lt;br /&gt;*The &lt;/span&gt;&lt;span style="font-family:verdana;"&gt;&lt;strong&gt;trustee is an entity, generally a title company, that holds the "Power of Sale" in the event of default.&lt;br /&gt;&lt;/strong&gt;*The &lt;strong&gt;trustee also reconveys the property once the deed of trust is paid in full&lt;/strong&gt;.&lt;br /&gt;*In the event of a default, the &lt;strong&gt;trustee files a Notice of Default&lt;/strong&gt;; however, in most instances, the trustee will substitute another trustee to handle the foreclosure under a Substitution of Trustee.&lt;br /&gt;*After the 90-day period in the public records, and a 21-day publication period in the newspaper, the &lt;strong&gt;trustee then has the power to sell the property&lt;/strong&gt; on the courthouse steps without a court procedure.&lt;br /&gt;*During the three months following recordation of the Notice of Default, the borrower can redeem the property by making up the back payments and paying the trustee's fees.&lt;br /&gt;&lt;strong&gt;*Once the trustee sells the property at a Trustee's sale, it is final&lt;/strong&gt;.&lt;br /&gt;&lt;br /&gt;&lt;/span&gt;&lt;span style="font-family:verdana;"&gt;&lt;span style="font-size:130%;"&gt;What is a &lt;strong&gt;&lt;span style="color:#ff0000;"&gt;Promissory Note&lt;/span&gt;&lt;/strong&gt;?&lt;br /&gt;&lt;/span&gt;*Whereas the &lt;strong&gt;&lt;span style="font-size:130%;"&gt;deed of trust&lt;/span&gt; is security of the debt, secured by the property&lt;/strong&gt;, the &lt;/span&gt;&lt;span style="font-family:verdana;"&gt;&lt;strong&gt;&lt;span style="font-size:130%;"&gt;promissory note&lt;/span&gt; is secured by the deed of trust and is the evidence of the debt.&lt;br /&gt;&lt;/strong&gt;*The &lt;strong&gt;promissory note is a promise to pay&lt;/strong&gt;, signed by the borrower in favor of the lender.&lt;br /&gt;*It &lt;/span&gt;&lt;span style="font-family:verdana;"&gt;&lt;strong&gt;contains the terms of the loan such as the interest rate and payment obligations.&lt;br /&gt;&lt;/strong&gt;*The &lt;strong&gt;promissory note is generally not recorded&lt;/strong&gt;.&lt;br /&gt;*When the loan is paid, the promissory note is marked "paid in full" and returned to the borrower, along with a recorded Reconveyance Deed.&lt;br /&gt;&lt;strong&gt;&lt;/strong&gt;*&lt;strong&gt;During the term of the loan, the lender retains the promissory note&lt;/strong&gt;.&lt;br /&gt;&lt;br /&gt;&lt;span style="font-size:130%;"&gt;Before Signing a Promissory Note and Deed of Trust &lt;strong&gt;you should always read both documents, including the pre-printed portions&lt;/strong&gt;.&lt;/span&gt; You might ask the closer to send you a blank deed of trust and promissory note beforehand. TIP: While alienation clauses can accelerate a loan, not all loan accelerations are called due and payable because of an alienation.&lt;br /&gt;Examples: An acceleration clause "accelerates" the loan balance.&lt;br /&gt;&lt;br /&gt;2) &lt;/span&gt;&lt;span style="font-family:verdana;"&gt;&lt;span style="font-size:130%;"&gt;&lt;strong&gt;"Alienation Clause"&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="font-size:130%;"&gt;Definition:&lt;/span&gt;&lt;/strong&gt; Language in a mortgage or trust deed that &lt;span style="color:#ff0000;"&gt;allows the lender to call the loan immediately due and payable in the event the owner sells the property or transfers title to the property&lt;/span&gt;. Any one that is in the &lt;strong&gt;&lt;span style="color:#ff0000;"&gt;home building and home construction industry&lt;/span&gt;&lt;/strong&gt; could run into this situation at times.&lt;br /&gt;&lt;br /&gt;You all know about the situation where you have a home or several homes that you have built on spec. (speculation). What can and often does happen is that the new home sales market calms down for a while and you have completed new homes in your inventory. &lt;span style="color:#009900;"&gt;&lt;strong&gt;&lt;span style="color:#ff0000;"&gt;Every month that they sit empty it costs you a great deal of money as well as lost profit&lt;/span&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;Then one day you hear of someone that is looking for a place to rent or live for a while. As a home builder your job is to build homes and not to carry an inventory of homes.&lt;br /&gt;&lt;br /&gt;You decide that you will rent some of the inventory of homes to people so that it will reduce your losses and you will still be able to make a profit on the home although you may have to wait longer to receive that profit. You decide to go ahead and rent out the home or several of your new homes.&lt;br /&gt;&lt;br /&gt;Time goes by and the renters decide to purchase the home and for various reasons you as a home builder decide to &lt;strong&gt;&lt;span style="color:#ff0000;"&gt;carry back a mortgage&lt;/span&gt;&lt;/strong&gt; and they will make monthly payments to you over the next 20, 25 or perhaps 30 years.
